These Terms & Conditions (the “Terms”) govern your access to and use of the website located at welcomecareinc.com, including its pages, content, forms, features, and other online functionality (collectively, the “Site”), which is operated by Welcome Care, Inc. (“Welcome Care,” “we,” “us,” or “our”). By accessing, browsing, submitting information through, or otherwise using the Site, you acknowledge that you have read and understood these Terms and agree to be bound by them. Our Privacy Policy separately describes how information associated with the Site is collected, used, disclosed, and protected. If you do not agree to these Terms, please do not use the Site.
Important scope limitation. These Terms govern use of the Site. They do not replace or modify any separate admission agreement, plan of care, clinical consent, service agreement, payer or Medicaid documentation, employment agreement, caregiver agreement, authorization, or other written agreement that may apply to actual services or employment. If there is a conflict, the applicable separately executed agreement controls with respect to that relationship, to the extent permitted by law.
Welcome Care is a New York home care organization serving families in Brooklyn, Queens, Manhattan, the Bronx, Staten Island, and Nassau County. The Site provides information about home care and related support, including Home Health Aide and Personal Care Aide services, Private Duty Nursing, Medicaid and social-service assistance, NHTD and TBI Waiver guidance, OPWDD enrollment guidance, pediatric home care, and therapy-related services or coordination, including physical therapy, occupational therapy, speech therapy, and ABA-related support.
The precise services available to a particular person depend on location, staffing, clinical need, licensure and scope-of-practice requirements, program rules, payer requirements, authorizations, assessments, physician or practitioner orders where required, and other applicable conditions.
The Site is intended to provide general information about Welcome Care and the types of services, programs, resources, and employment opportunities that may be available. Site content is provided for informational and educational purposes and may be summarized for readability.
Information on the Site may not reflect every eligibility criterion, authorization requirement, benefit limitation, clinical requirement, payer rule, regulatory requirement, or service condition that applies to a specific person. You should not make health, legal, insurance, Medicaid, employment, or financial decisions solely on the basis of Site content.
The Site, its forms, email addresses, and other online communication channels are not monitored as emergency services and must not be used for urgent or emergency medical needs. If you believe you or another person may be experiencing a medical emergency, call 911 or go to the nearest emergency department. Do not delay emergency care while waiting for a response from Welcome Care.
Nothing on the Site constitutes medical diagnosis or treatment, nursing advice for an individual, legal advice, insurance advice, Medicaid eligibility advice, benefits counseling, or a guarantee of coverage or approval. General descriptions of services, conditions, programs, waivers, or benefits are not a substitute for individualized assessment by appropriately qualified professionals or determinations by the applicable government agency, managed care organization, insurer, payer, or other authorized decision-maker.
Welcome Care may help families understand processes, organize information, or navigate next steps. However, final eligibility, authorization, benefit, service-level, reimbursement, or coverage decisions are made by the applicable agencies, programs, plans, payers, or other authorized entities under their own rules.
Visiting the Site, reading content, submitting a form, requesting information, requesting a free assessment, sending an email, or speaking with a representative about general services does not by itself create a client, patient, provider-patient, nurse-patient, caregiver-client, fiduciary, attorney-client, insurance-advisor, or other professional relationship.
A care or service relationship begins only after Welcome Care has completed any required intake, assessment, verification, admission, authorization, contracting, consent, and other onboarding steps and has affirmatively accepted the person for the applicable service. Any clinical or service obligations are governed by applicable law, the plan of care, orders, program rules, and separate documentation, not by the Site alone.
When the Site refers to a “free assessment,” “get started” request, caregiver inquiry, consultation, or similar contact, it generally means an initial inquiry or screening process unless expressly stated otherwise. It is not necessarily a comprehensive clinical assessment, formal Medicaid determination, OPWDD eligibility determination, waiver approval, nursing evaluation, or guarantee that Welcome Care will be able to provide services.
Submitting an inquiry does not reserve staffing, establish a start date, guarantee admission, guarantee caregiver placement, or create an obligation for Welcome Care to accept a case. Additional information, documentation, assessments, orders, authorizations, and agreements may be required before services can begin.
Service descriptions on the Site are subject to applicable law and program requirements. Availability may vary by county, borough, age, diagnosis, functional need, staffing, payer, managed care plan, Medicaid coverage category, physician or practitioner orders, clinical assessment, level-of-care determination, program capacity, and other factors.
Any references to potential service hours, frequency, benefits, waiver participation, reimbursement, or coverage are illustrative only unless Welcome Care confirms otherwise in writing for a specific case. Welcome Care does not guarantee that any person will qualify for a particular number of care hours, a particular program, a particular caregiver, or a particular therapy or service.
For government-administered or payer-administered programs, the responsible agency, plan, or authorized reviewer—not this Site—makes the final eligibility and authorization determination. This includes, as applicable, Medicaid, OPWDD services, NHTD, TBI Waiver services, and other public or private benefit programs.
Certain services may require an individualized assessment, a physician or other authorized practitioner order, a plan of care, periodic reassessment, clinical supervision, or other documentation. Services are provided only within the scope permitted by applicable law, professional licensure, program rules, payer authorization, and the individual’s approved plan of care.
Website descriptions are not instructions for self-treatment and do not authorize a caregiver, aide, nurse, therapist, or other professional to perform any task outside the person’s approved plan of care or professional scope of practice.
Welcome Care may describe caregiver matching, family-recommended caregivers, scheduling flexibility, or similar service features. Actual caregiver placement and scheduling depend on eligibility, training and credentialing requirements, availability, authorization, compatibility, service area, and other operational or clinical considerations.
Unless expressly confirmed through the applicable service process, Welcome Care does not guarantee the availability of any particular caregiver, nurse, therapist, language, schedule, shift, start date, or number of service hours.
The Site contains forms for general inquiries, caregiver requests, service-interest requests, contact messages, and employment applications. Please provide only information reasonably necessary for the purpose of the form.
Do not use a general website form or ordinary email to send highly sensitive medical records, Social Security numbers, Medicaid identification numbers, financial account information, passwords, or other sensitive information unless Welcome Care specifically directs you to an approved secure method. If detailed health information is needed, Welcome Care may request that it be provided through an appropriate channel.
Internet and email communications may carry security risks. Although Welcome Care uses reasonable safeguards, no internet transmission method can be guaranteed to be completely secure.
Welcome Care’s Privacy Policy separately explains how information collected through the Site may be collected, used, disclosed, retained, and protected. Your use of the Site is also subject to the privacy practices described in that policy and to applicable privacy law.
Where Welcome Care is acting as a HIPAA covered entity and information constitutes protected health information (“PHI”), applicable HIPAA requirements and Welcome Care’s Notice of Privacy Practices govern the use and disclosure of that PHI. These Terms and the website Privacy Policy are not intended to replace the Notice of Privacy Practices.
If there is a conflict between these Terms and a legally required privacy notice or authorization with respect to PHI, the applicable privacy notice, authorization, or law will control.
If you provide a telephone number or email address in connection with an inquiry or application, you authorize Welcome Care to use that contact information to respond to you and to communicate about the specific inquiry, application, requested service, scheduling, intake, or other relationship you initiated, subject to applicable law.
Your use of the Site alone does not constitute consent to receive marketing text messages where separate consent is required by law. If Welcome Care offers an optional SMS or marketing program, the applicable consent language and opt-out instructions will govern that program. Message and data rates may apply to text messages depending on your mobile plan.
You are responsible for keeping your contact information accurate and for safeguarding access to your email account and mobile device.
The careers section of the Site allows individuals to express interest in employment opportunities and submit information such as contact details, availability, role preferences, resumes, and certifications. Submission of an application or other information does not create an employment relationship, guarantee an interview, guarantee placement, or constitute an offer of employment.
Employment opportunities are subject to staffing needs, qualifications, license or certification requirements, documentation, background checks or screenings where permitted and required, training, onboarding, eligibility to work, and other lawful conditions. Any employment relationship, if established, will be governed by separate onboarding documents, policies, and applicable law.
Welcome Care is an equal opportunity employer to the extent required by applicable law. Nothing on the Site should be interpreted as modifying any rights or obligations under applicable employment law.
The Site is intended for use by adults. Parents, guardians, and other legally authorized representatives may use the Site to seek information or services for a minor or another person they are authorized to represent.
If you submit information about another individual, you represent that you are authorized to provide the information and to request contact or assistance on that person’s behalf. Additional verification of authority or consent may be required before Welcome Care can disclose information or act on a request.
You agree that information you submit through the Site will be accurate to the best of your knowledge and will not knowingly be false, misleading, fraudulent, or submitted without proper authorization. You are responsible for updating Welcome Care if material information changes during an active inquiry or application process.
Welcome Care may rely on the information you provide for preliminary routing, follow-up, or screening, but may independently verify information when appropriate or legally required.
You may use the Site only for lawful purposes and in accordance with these Terms. You may not:
Unless otherwise stated, the Site and its original text, layout, graphics, logos, photographs, illustrations, videos, icons, downloads, and other content are owned by or licensed to Welcome Care and are protected by copyright, trademark, and other intellectual-property laws.
Welcome Care grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial informational purposes. You may print or save reasonable portions of the Site for your own personal reference, provided you do not remove proprietary notices or misrepresent the source.
No other rights are granted by implication, estoppel, or otherwise. If you believe material on the Site infringes your copyright or other intellectual-property rights, please contact Welcome Care using the information in Section 35.
“Welcome Care,” associated logos, service marks, and other branding displayed on the Site are the property of Welcome Care or their respective owners. Other names, logos, and marks belong to their respective owners.
References to Medicaid, OPWDD, NHTD, TBI Waiver programs, government agencies, accreditation bodies, insurers, managed care organizations, or third-party programs are used for identification and informational purposes. Unless expressly stated, such references do not imply sponsorship, endorsement, partnership, or a guarantee of authorization or eligibility.
The Site may display reviews, testimonials, ratings, or other statements from clients, families, caregivers, employees, or third-party platforms. These statements reflect individual experiences and opinions and are not guarantees that every person will have the same experience or outcome.
Clinical, functional, service, employment, and benefits outcomes vary based on individual circumstances and factors outside Welcome Care’s control.
Images on the Site may include stock photography, staged imagery, AI-generated imagery, digitally created or enhanced imagery, or other illustrative media. Unless expressly identified otherwise, such images are used for illustrative and design purposes and should not be interpreted as depicting actual patients, clients, caregivers, employees, locations, procedures, or outcomes.
The Site may link to or embed third-party websites, maps, directions, review platforms, social media, analytics tools, scheduling or communications services, or other external resources. Welcome Care does not control third-party services and is not responsible for their content, availability, security, privacy practices, terms, or accuracy.
A link or integration does not necessarily constitute endorsement. Your use of third-party services is governed by the third party’s own terms and privacy policies.
Welcome Care may modify, suspend, restrict, or discontinue any part of the Site at any time. The Site may occasionally be unavailable due to maintenance, updates, security issues, internet failures, third-party outages, or circumstances beyond Welcome Care’s reasonable control.
Welcome Care does not guarantee that the Site will be uninterrupted, error-free, free of harmful components, or compatible with every browser, device, assistive technology, network, or configuration. You are responsible for using reasonable security measures on your own devices and accounts.

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Welcome Care and its officers, directors, employees, and agents from third-party claims, liabilities, damages, judgments, losses, costs, and reasonable attorneys’ fees arising out of your unlawful misuse of the Site, your material violation of these Terms, your infringement of a third party’s rights, or information you knowingly submit without authorization.
This indemnification provision does not apply to claims based on Welcome Care’s provision of professional home care or clinical services to the extent such claims are governed by separate law, duties, or agreements.
Actual home care, clinical, therapy, nursing, waiver, payer, employment, or other services may be governed by separate documents and legal requirements. Nothing in these Terms is intended to waive patient rights, employee rights, consumer rights, privacy rights, disability rights, or any other right that cannot legally be waived.
If a separate signed agreement or legally required notice conflicts with these Terms regarding a specific service or relationship, the separate agreement or legally required notice will control to the extent of the conflict, subject to applicable law.
Welcome Care may update the Site and these Terms from time to time to reflect changes in services, technology, operations, law, or business practices. When these Terms are revised, the “Last Updated” date will be changed. Revised Terms become effective when posted unless a different effective date is stated.
Your continued use of the Site after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law. Material changes that require additional notice or consent under applicable law will be handled accordingly.
Welcome Care may restrict or terminate access to all or part of the Site if it reasonably believes a user is violating these Terms, threatening Site security, abusing forms or systems, violating law, or interfering with other users. This provision does not affect any separate rights or obligations relating to an active client, patient, employee, applicant, or service relationship.
The Site is operated from the United States and is primarily intended for individuals seeking information about services in New York locations served by Welcome Care. Welcome Care does not represent that Site content or services are appropriate, licensed, authorized, or available in every jurisdiction. If you access the Site from outside the service area or outside the United States, you do so on your own initiative and are responsible for compliance with applicable local law.
These Terms and disputes arising solely from use of the Site will be governed by the laws of the State of New York, without regard to conflict-of-law principles, except where federal law applies or applicable law requires otherwise.
Subject to any non-waivable rights or mandatory venue rules, any court proceeding arising solely from these Terms or Site use shall be brought in a state or federal court of competent jurisdiction located in Kings County, New York, and you consent to personal jurisdiction and venue there.
This governing-law and venue provision is intended for website-use disputes and does not override a different lawful dispute-resolution provision in a separate signed service, employment, payer, or other agreement.
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect. Welcome Care’s failure to enforce any provision is not a waiver of its right to enforce that or any other provision later.
You may not assign or transfer your rights or obligations under these Terms without Welcome Care’s prior written consent. Welcome Care may assign these Terms in connection with a merger, reorganization, change of control, transfer of Site operations, or other lawful business transaction, subject to applicable law.
These Terms, together with any additional terms expressly presented for a specific Site feature, constitute the agreement between you and Welcome Care regarding use of the Site. The Privacy Policy is a separate notice describing Welcome Care’s website privacy practices and does not limit rights provided by applicable law. These Terms supersede prior statements or understandings concerning Site use only. They do not supersede separate agreements governing actual services, employment, clinical care, payer relationships, privacy notices, or other non-website matters.
